Preamble

These general conditions of sale apply to all sales made between Magdalena Chmielarska / Cool Kids Atelier (the Seller) and buyers (the Customer) on the website www.coolkidsatelier.com . Consequently, the fact of ordering, for any Customer, one or more items offered on the Cool Kids Atelier online shop implies full and complete acceptance of the general terms and conditions of sale established below and of which the Customer acknowledges having read prior to the validation of his order.

Article 1: Purpose

Thus, these general conditions of sale define the rights and obligations of each party in the context of online sales on the website www.coolkidsatelier.com from the order to the delivery of the products, including payment.

Article 2: Scope of application

These general conditions of sale apply to the different methods of placing orders proposed by Cool Kids Atelier; either directly on the website www.coolkidsatelier.com or via Instagram and Facebook.

Article 3: Prices

The price of each item is indicated in Euros. The sale price is net and excluding shipping costs. Shipping costs are not included in the price, they are indicated before the validation of each order.

The Seller reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time the order is placed, subject to availability.

Article 4: Availability of products

Cool Kids Atelier regularly updates the stocks of its products offered and undertakes to honour all orders received within the limits of available stocks. If an unavailability occurs after validation of the order, Cool Kids Atelier undertakes to notify the Customer as soon as possible by e-mail or telephone. The Seller will cancel the unavailable order or refund it to the Customer.

Article 5: Ordering

Every client declares that he/she has the capacity to contract under the conditions described below, i.e. to be an emancipated minor or to have reached the age of legal majority and not to be protected within the meaning of article 488 of the French Civil Code.

The seller reserves the right to refuse any order from a Customer with whom a dispute exists or appears during the processing of an order, in particular a payment dispute.

The Customer can place his order on the Cool Kids Atelier online shop 24 hours a day, 7 days a week. The ordering process consists of several successive steps. The Customer chooses an item and selects the size/colour (when applies) and quantity desired and adds it to his basket. Once the shopping is finished, the Customer checks his basket and must accept the general conditions of sale before proceeding to the next step. Then the Customer can create or register in his customer area or continue as a guest by providing the necessary information for payment and delivery of his order. Once the order is validated and the full payment received, the Customer receives by email a confirmation of his order (provided that the email address indicated in the registration form does not contain any errors). He can track the delivery of his order directly on the Cool Kids Atelier website.

Article 6: Payment terms

The Customer can pay online by credit card (Carte Bleue, Visa, Eurocard-Mastercard and American Express), Paypal and Apple Pay.

The payment is secure.

The Seller reserves the right to suspend any order processing and delivery in the event of refusal of authorization of payment by credit card from officially accredited organizations or in the event of non-payment.

Article 7: Delivery

For deliveries in metropolitan France, shipments are possible either by followed letter (order of less than 3 cm thick), by Colissimo or by Mondial Relay. Delivery costs vary according to the size and weight of the order and the choice of delivery.

For shipments outside metropolitan France, please write to us directly at contact@coolkidsatelier.com to choose the best shipping solution with you.

The delivery times indicated are indicative times. The Seller shall not be liable for any loss or delay in delivery due to errors or disruptions attributable to the carrier; as in the event that the address provided by the Customer has been incomplete or incorrect.

The costs incurred for a possible reshipment or a new presentation by the deliverer will be at the expense of the Customer. 

For reasons of availability, and if the Customer so wishes, an order can be delivered in several instalments. 

Article 8: Exchange and refund

The Customer has the possibility to change his mind and return an item within 14 days of delivery of the order. Items must be returned in their original packaging, not deconditioned, not worn, not used and clean.

The goods are to be returned by registered mail to the following address: Magdalena Chmielarska / Cool Kids Atelier, 6 rue de Musselburgh, 94500 Champigny sur Marne; after having informed the Seller: contact@coolkidsatelier.com

Shipping costs will be charged to the Customer.

The products are packed in compliance with transport standards and to ensure protection during delivery. The Customer is requested to respect these same conditions when returning a product. If the Seller notices that the product has been damaged due to insufficient packaging quality, he may decide to only partially refund the product.

Refunds will be made within a maximum of 30 days from the date of return of the package, depending on the payment method used at the time of purchase.

Article 9: Right of withdrawal

In accordance with article L.121-20 of the French Consumer Code, the Customer has a withdrawal period of fourteen (14) calendar days from the date of receipt or withdrawal of the Articles to exercise his legal right of withdrawal and thus notify Cool Kids Atelier of the said return.

If the Customer exercises this right under the conditions provided for in terms of time and return procedures, he may obtain a refund of the returned product(s) within 30 days following the date on which this right is exercised.

Article 10: Warranty and Complaint

In accordance with Article L217-4 of the Consumer Code, the Customer benefits from the legal guarantee of conformity which is incumbent on the Seller to deliver a good in conformity with the contract and to answer for any lack of conformity existing at the time of delivery. 

On the other hand, the Customer is responsible for inspecting his package and the item(s) it contains upon receipt of it within a maximum period of seven (7) days from its delivery. Beyond the time limit, the product(s) will be considered compliant and any claim will be considered void.

Article 11: Liability and force majeure

Cool Kids Atelier is not the manufacturer of the products offered on its online store, the Seller cannot be held responsible for any damage caused to a person or property by a product that is found to be defective. It is the Customer's responsibility to verify the use of the products and to supervise their use with minors.

In the event of delayed or impeded performance of the contract due to force majeure (unforeseeable, unavoidable circumstances beyond our control), we consider that neither the Seller nor the Customer will have failed to fulfil their contractual obligations insofar as the affected party expressly notifies the other party.

Article 12: Intellectual Property

All texts, images, illustrations, videos and graphics are reserved under copyright and intellectual property law and for the whole world. Without prior authorization, any reproduction of the Cool Kids Atelier site, whether partial or total, is strictly prohibited.

Article 13: Protection of personal data

In accordance with the "informatique et libertés" French law, the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL) under number 2182050.

Indeed, in order to ensure the follow-up of orders and invoicing, Cool Kids Atelier collects and stores personal information relating to the Customer. However, the latter has the right to access, modify, rectify and delete data concerning him/her, in accordance with article 34 of the law "informatique et libertés" of 6 January 1978.

Article 13: Applicable law

These general terms and conditions of sale are subject to French law and apply throughout the duration of the online launch of the merchant site.

Cool Kids Atelier reserves the right to modify these general terms and conditions of sale at any time.
